General terms and conditions
Area of applicationChateau-Coaching proposes services for private persons, enterprises and institutions, in the field of coaching and consulting referring to the offer on the website www.chateau-coaching.com.
The present general conditions govern the business relationship between Chateau-Coaching and its clients. By commissioning Chateau-Coaching the client/mandator (orderer or sponsor) accepts these general conditions which are part of the contract agreement. Deviation from these general conditions imply a written agreement between Chateau-Coaching and the client/mandator.
ProceedingThe coaching and consulting-process is personalized. For this, the eligible coaching services are conjointly agreed between Chateau-Coaching and the person in demand of coaching and/or the mandator, regularly evaluated and adapted if necessary.
If desired, the first step is a phone call of 45 minutes, this is free and includes exclusively: the presentation of both the person in demand and Chateau-Coaching, a brief description of the situation, the answering of questions from both sides and the clarification if and in which form a business relationship would be possible.
Following this first contacting and based on information given by the client and/or the person in demand of coaching, Chateau-Coaching sets up an offer of services with the scope of the corresponding prices. Besides the pay scale and the services, the offer defines agreed objectives, a time schedule and the principle of operation for the coaching process and consulting.
Contractual agreements (for companies and institutions)If the client/mandator approves the offer, and the general terms and conditions, and places an order either written or by phone, Chateau-Coaching will communicate the order confirmation to the mandator.
Based on the order confirmation, Chateau-Coaching will take actions according to the scope of services agreed together and establish the corresponding invoice referring to the issued offer.
Would additional work and expense appear to be necessary in the course of the coaching process, Chateau-Coaching will inform the mandator about it and they will formulate together an adapted range of services and a respectively a modified offer.
Allocable activitiesThe following services are allocable:
- Coaching sessions and consulting in Chateau-Coaching office or outwards
- Expenses, travel time and external costs specified in the offer
The following services are non-allocable and are part of the contractual agreements:
- The first 45 minutes conversation (by phone or at Chateau-Coaching office)
- The preparation time and treatment time before and after the coaching or consulting session
Compensation and tariffs
Chateau-Coaching allocates provided services according to the work provided and the ratification agreed in the offer.
Conditions of paymentChateau-Coaching establishes invoices at the end of the month or once the services provided have ended, according to the offer. Invoices are allocable within 14 days starting at the day of invoicing. According to Art. 10 Abs. 2 Bst. a Schweizer MWSTG7 Chateau-Coaching services are free of VAT.
Compensation in case of a missed or cancelled appointmentThe coaching or consulting sessions cancelled with less than 48 hours of advance notice are not charged (for Monday’s sessions until Friday 12:00 am). Should this not be the case, the cancellation fee is equal to up to 100% of the foreseen honorary.
In case of cancellation without notice, expenses can be as much as the maximum hourly rate commonly agreed.
Confidentiality and data protectionAll the conversations conducted during the coaching and consulting sessions shall be confidential and shall be covered by the obligation of professional secrecy, this also towards the mandator if the latter is not the person in demand of coaching.
The person being coached may, at any time, consult the documents and the notes taken by Chateau-Coaching about him/her. No right shall exist to the release of these documents, which are and remain the property of Chateau-Coaching.
The results of a coaching may only be communicated to third parties with the written approval of the person being coached and the mandator.
ResponsibilitiesChateau-Coaching undertakes to use its best efforts in acting but does not guarantee a certain result. Chateau-Coaching declines any responsibility for the professional and personal decisions that the client may take during and after the coaching period. In any case Chateau-Coaching’s responsibility shall be limited to fees established with the client/mandator. Forwarding documents to the mandator shall be carried out at the cost and risk of the latter.
InsuranceThe mandator is always the organiser of the team-coaching sessions, seminaries, workshops etc. The mandator is responsible for the insurance of the participants. Chateau-Coaching does not cover personal injuries or property damages.
Applicable Law and JurisdictionSwiss law alone applies. Basel-Town is the place of jurisdiction.
